The Hot Tub Factory – Terms & Conditions 

Prices. Prices include VAT and where quoted are valid for 30 days unless otherwise stated. Delivery and packaging are not included unless otherwise stated.

Deposits. Reservation deposits are refundable if within 21 days of payment. Booking deposits are non-refundable, however under extreme circumstances and when agreed by the Company Director a proportion of the deposit may be refundable at the discretion of The Hot Tub Factory. In all cases, a minimum of £200.00 shall be retained to cover administration costs.

Site Surveys. Site Surveys will be carried out by one of our team members once a deposit has been paid unless stated otherwise by the Company Director of The Hot Tub Factory.

Payment. A minimum deposit of £200 or in certain circumstances 10% of the total price will be required to reserve the required specification of spa and goods. The remaining full balance will be paid before the delivery of goods. Payments by cash must be paid at least one working day before delivery. Payments are made by cheque 7 days before delivery, credit/debit card payments must be paid a minimum of working days before delivery to allow time for clearance. The Hot Tub Factory will retain full responsibility for the goods (unless an independent crane or HIAB is used for installation. (See Paragraph Independent Cranes/HIAB Lifts) until the goods are installed to a satisfactory standard.

Goods. All goods will remain the property of The Hot Tub Factory until paid for in full.

Credit Cards. Due to the recent changes in the law regarding Credit Card charges, deposits over £200 and balance payments will not be accepted by Credit Card. We DO NOT accept American Express.

Special Offers. Where an order has been placed for a specific item and at a later date that particular item may be reduced and offered for sale at a lower price the customer cannot attempt to reclaim any such difference

Deliveries. Goods are dispatched using selected carriers to avoid losses and damage during transit. Normally a specific day is arranged but the exact time cannot be guaranteed. In extreme circumstances, carriers may not be able to deliver the goods on the specified date. Where this is the case they will deliver at the earliest opportunity. The Hot Tub Factory cannot be held responsible for any delays caused by uncontrollable circumstances.

DIY Installations. The customer is responsible for checking that all items ordered have been received. Any discrepancies must be recorded and notified ASAP. It is strongly advised that all parts are confirmed present before the commencement of installation.

Installations. Where The Hot Tub Factory are carrying out the installation without site preparation completed by The Hot Tub Factory, the quotation given does not include: –
1. Any electrical installation. A qualified Part ‘P’ registered electrician must carry out all work and must be present to make the final connection to the appliance being installed during                installation.
2. Any groundwork: It is the customer’s sole responsibility to provide a suitable firm and level site for installation. If The Hot Tub Factory cannot carry out the installation on the arranged         date due to the site being unsuitable and have to return on a consecutive day. A further charge will be made to cover transportation and loss of earnings.
3. Building materials: The customer provides any such materials The Hot Tub Factory may on request arrange such items for supply and delivery.
4. Any travelling rates and expenses incurred by installation teams unless otherwise agreed.
5. Any work needed to be carried out by The Hot Tub Factory to gain access to the nominated site including wall or fence dismantling and reconstruction.
6. Any work required ad-hoc to gain access or equipment required and will incur an additional charge unless otherwise agreed by The Hot Tub Factory.
7. Any electrical connection required from a supply not installed by The Hot Tub Factory or any additional work required to make such connections.

Plans and Drawings. Remain the property of The Hot Tub Factory and therefore used solely between the two parties unless otherwise agreed in writing.

Drains and Drainage. If during the installation of a project by The Hot Tub Factory, drains are discovered that were not apparent at the time of the survey by The Hot Tub Factory, it is the customer’s sole responsibility to seek advice and cover any costs incurred for the removal/relocation of those drains. In the event of this happening The Hot Tub Factory will not be responsible for any delay or costs due to the completion of such tasks. The Hot Tub Factory will, however, waver any additional costs due to re-booking for installation

Independent Cranes/Hiab Lifts. In the event of an independent crane being required, it is the customer’s sole responsibility to ensure that the crane company provided has adequate insurance for the required lift. The Hot Tub Factory accepts no responsibility or liability associated with an independent crane lift. If any item that is lifted by the crane company is damaged during that lift, The Hot Tub Factory cannot be held responsible for that damage or any costs involved in repairing that damage. The Hot Tub Factory may recommend a Crane company to assist in the installation of the project. This is however solely a recommendation and not a sub-contracted agreement. The arrangement and price agreed with the recommended company are solely an agreement between the customer and the crane company and The Hot Tub Factory accepts no responsibility or liability associated with a crane lift of this nature. In the event of an independent crane or HIAB lift, the goods must be paid for in full before the lift commences.

Crane and HIAB lift recommended and subcontracted by The Hot Tub Factory are insured and are the responsibility of THE CRANE COMPANY.

Damage to Property. During the supply and installation of any products, The Hot Tub Factory will endeavour to minimise the amount of damage to surrounding areas and property. It is the customer’s responsibility to prepare the proposed site access suitably and safely to avoid damage and it is the customer’s sole responsibility to have adequate insurance to cover any such damage should it occur. The Hot Tub Factory will not be accountable for any such damage.

Special Orders. Where an item has been manufactured specifically to the customer’s requirements, (i.e. Special Order) a deposit of 50% to the value of that item will be required before the order can be processed. If at any time the customer needs to cancel the order and work have already commenced on the manufacture of a tailor-made item (Special Order,) then the deposit payment will not be refundable. This is non-negotiable.

Pipework and fittings. All pool DIY packages are supplied with enough rigid or flexible pipework and fittings for the location of the filter and pump approximately 2 meters from the pool. Any additional pipework or fittings required will be charged to the customer.

Spa Deliveries. All spas are delivered and commissioned in accordance with the manufacturer’s standard commissioning guide. Any spas delivered directly to the customer without installation will be the sole responsibility of the customer to follow the recommended installation instructions. The Hot Tub Factory will not be responsible for any spas installed incorrectly and any subsequent damage as a result of incorrect installation.

Quotations. Quotations are based upon information supplied and gathered at the time of inquiry. If during the commencement of installation, work other than that included in the quotation is needed to carry out in order to make installation proper, any additional costs will be charged to the customer.

Planning Permission. Above ground and partially in-ground swimming pools and portable spas generally require no planning permission in the UK. It is, however, the customers’ responsibility to check that no permission is required for the install, ie a covenant may be applied to the property. The Hot Tub Factory will advise on such circumstances but is not responsible for checking or gaining permission for any install.

The Hot Tub Factory supplies all products on the understanding that it is the customer’s responsibility to check and obtain any necessary permission from local authorities for any products supplied by The Hot Tub Factory.

Access For Installation. Any access requirements through or via a neighbour’s property or separate landowner’s property must be authorised by the customer and are not the responsibility of The Hot Tub Factory. Any disputes with neighbours, landowners, or local authorities as a consequence of the installation are not the responsibility of The Hot Tub Factory.
Modification of site. Any work completed to the site post-installation that could make access for service or repair (i.e. decking, fencing, walls) unobtainable or unsafe, must be removed/dismantled to allow suitable/safe access to necessary components within the unit. Alternatively, the customer will pay an additional charge depending on the work required to gain access. This must be agreed and paid for in full before work will commence.

Guarantees. All products are supported by a manufacturer’s warranty. This does not include carriage charges. All products are guaranteed with regards to labour for one year from the date of installation. Labour charges will be applicable post-warranty. Any work, repairs, or modifications completed by the customer or by any third party including servicing will void any warranties offered by THTF.

Free Items. Any goods given and identified on receipts or remittance advice as FREE will be covered by the relevant manufacturer’s warranty only, and any warranty work or replacements must be dealt with directly through the respective manufacturer. The Hot Tub Factory will not be responsible for such claims.

Callout Charges. Any callouts deemed as a result of neglect, i.e. poor water quality, dirty filters, or general overall neglect, will be subject to a minimum £90 call-out charge.

Warranty Conditions. Warranty begins from the original date of delivery/installation. Any unauthorised access gained to any sealed component panel or enclosed equipment, including modifications or the adding of additional equipment will void all warranties. Any damage due to negligence or misuse of equipment will void all warranties. Warranty will be deemed invalid with the sale of the spa to a third party.

Acceptance of Terms and Conditions of Sale. Upon placing an order with The Hot Tub Factory and securing by way of deposit you are agreeing to accept these terms and conditions of sale.

Packaging. Unfortunately due to increasing costs in commercial refuse disposal, any packaging from any products supplied by The Hot Tub Factory is the customer’s responsibility and will not be removed from the site by The Hot Tub Factory unless agreed by the company director and in writing or part of a written contract.

ANY VARIATIONS TO THE TERMS AND CONDITIONS STATED ABOVE MUST BE AGREED UPON BY THE HOT TUB FACTORY AND MUST BE CONFIRMED IN WRITING.
